They govern your access to and use of the JustGuard cybersecurity platform (the "Service") provided by JustGuard ("Company," "We," "Us," or "Our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Interpretation and Definitions

These definitions apply to all parts of these Terms:

  • Company (We, Us, Our) refers to JustGuard, (BE0804.357.949), registered in Belgium.

  • Affiliate means an entity controlling, controlled by, or under common control with the Company.

  • Country refers to: Belgium.

  • Service refers to the JustGuard cybersecurity platform accessible from https://justguard.be

  • You means the individual or the company/legal entity accessing or using the Service.

Service Use and Acknowledgement

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and our Privacy Policy. These documents form the entire agreement between you and the Company.

You confirm that you are over the age of 18. The Company does not permit use of the Service by individuals under 18.

By using the Service, you acknowledge and agree that you have read and understood our Privacy Policy, which describes how we handle your personal information.

Intellectual Property and User Content

The Service and its original content, features, and functionality are and will remain the exclusive property of JustGuard and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign nations.

You retain ownership of any data, code, or content you submit, post, display, or upload on or through the Service ("User Content"). By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and analyze the User Content strictly for the purpose of providing and improving the core cybersecurity scanning service to you.

You warrant that the User Content is yours or that you have the right to grant us the license described above.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, the total liability of the Company and its suppliers under these Terms, regardless of the claim, is limited to the amount you actually paid to the Company through the Service in the twelve (12) months preceding the claim, or $100 USD if you have not made any purchases.

The Company and its suppliers will not be liable for any special, incidental, indirect, or consequential damages (including loss of profits, data, business interruption, or personal injury) arising out of the use or inability to use the Service, even if advised of the possibility of such damages.

Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, some of the above limitations may not apply to you. In such cases, the Company's liability will be limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

The Company does not warrant that the Service will meet your requirements, achieve any intended results, operate without interruption, be compatible with any other system, or be error-free.

General Legal Provisions

Governing Law

The laws of the Country (Belgium), excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

Disputes Resolution

If You have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

As an EU consumer, you benefit from any mandatory provisions of the law of the country in which you are resident.

Our Service may contain links to third-party websites or services that are not controlled by the Company. We assume no responsibility for the content, terms, or privacy policies of any third-party websites. We strongly advise you to read the terms and policies of any third-party sites you visit.

Severability and Waiver

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
